1. GENERAL CONDITIONS/SCOPE OF APPLICATION

The following General Terms and Conditions apply to all contracts concluded between Ensure! and the interested party as well as to any use of the services provided by Ensure!, in particular consulting, calculations, tariffs and other data. By using the range of services provided by Ensure!, including advice given by telephone, these terms and conditions shall be deemed to have been agreed as binding, unless otherwise expressly agreed in writing or mandatory by law. Any terms and conditions contrary to or deviating from these General Terms and Conditions shall not apply.

2. SERVICES

Ensure! exclusively provides end consumers with non-binding information on rates and conditions of financial service and/or insurance providers free of charge. The interested party is provided with an overview of the various insurance and financial service products based on his inquiry by transmitting comparison results. For this purpose, the interested party must enter the necessary search criteria, selected solely by the interested party, and submit a corresponding request regarding the services desired by the interested party and agree to the transfer of his data to the corresponding financial service and/or insurance providers for the preparation of a concrete offer. Based on his search request, the interested party will receive up to three, mostly non-binding, offers from the corresponding financial service and/or insurance providers. The selection of the financial service and/or insurance providers accessible via the offer of Tim Bütecke, the financial service or insurance products offered by these providers as well as the methods for determining the providers in question are the sole responsibility of Tim Bütecke. The search request is the offer of the interested party, which is only deemed to be accepted by the transmission of the result of the data processing on the basis of the actually available data. The concrete offers of the financial service and/or insurance providers may deviate from the individual rates or conditions calculated and made available via Tim Bütecke in individual cases due to certain individual constellations. The providers are solely responsible for the content and correctness of the offers. A possible insurance or financial service contract is exclusively concluded directly between the interested party and the respective financial service and/or insurance company. Ensure! cannot guarantee or influence the acceptance or conclusion of a specific contract with a provider. The respective financial service and/or insurance company alone decides on this in individual cases. Ensure! can forward the customer's inquiry to specialized service providers in Germany. In order to process your request, we need some of your personal data. These will be passed on by us to professional, competent cooperation partners (insurance brokers or financial service providers). Our cooperation partners will then contact you by telephone and help you free of charge and without obligation.

3. WARRANTY/LIABILITY

Ensure! strives for completeness, accuracy and continuous updating of the underlying data material, but is not obligated to do so. The data, information and documents originate exclusively from the financial service and/or insurance providers themselves, which are provided by Ensure! without any guarantee for their content and the resulting information and calculations. Furthermore, Ensure! does not guarantee the accuracy and completeness of the data material, in particular that all financial service and/or insurance providers on the market are included in the comparison calculation. The data determined on the basis of the prospective customer's inquiry will be forwarded directly and as promptly as possible to the financial service and/or insurance providers selected in each case. Ensure! cannot, however, guarantee the correct, complete and timely transmission of the data, nor can it guarantee that the offers of the financial service and/or insurance providers will be forwarded to the interested party. The use of the offered services by the interested party is in any case at his own risk. Liability on the part of Ensure! is excluded insofar as Ensure! or one of its legal representatives or vicarious agents is not responsible for intent or gross negligence. In this respect, the rights of the interested party remain unaffected.

4. RULES OF USE

The interested party is responsible for the accuracy and completeness of the information provided in the search request. Ensure! shall not be liable for any information provided on the basis of false or incomplete data. In case of intentionally untrue information provided by the interested party, Ensure! is entitled to exclude the interested party from using the information service and, in particular, to leave the search request unprocessed and to claim damages. Commercial use of the information and calculations is expressly not permitted. Only the end user is allowed to use the information free of charge. End consumers in the sense of these General Terms and Conditions are the interested parties who are not acting as agents for insurance or financial service products or as providers of such products, even in the broadest sense. The making of - complete or partial - copies of the Ensure! -Internet applications or any data contained therein is expressly prohibited. The same applies to the sale or any other kind of distribution or publication of the calculations created with the Ensure! -Internet applications. A contractual penalty of EUR 10,000.00 shall be levied for each case of infringement, excluding the defense of continuation of the infringement. The assertion of further claims for damages shall remain unaffected. Furthermore, any right of use shall expire with immediate effect in the event of violations of these protective provisions.

5. DATA PROTECTION

The personal data entered by the interested party will be stored and deleted upon request (note according to § 28 para. 1 BDSG). For the use and forwarding of his data to the insurance or financial service providers, which is necessary to process the inquiries, the interested party gives his consent by submitting and sending the search inquiry (§ 3 TDDSG). Look at our detailed privacy policy.

6. DISPUTE RESOLUTION

The European Commission provides a platform for online dispute resolution (OS), which you can find here http://ec.europa.eu/consumers/odr/. Consumers have the option to use this platform to resolve their disputes.

7. FINAL CLAUSE

If any clause of these General Terms and Conditions is not legally effective, the remaining clauses shall remain unaffected. German law shall apply exclusively to the agreements concluded with Ensure! If the contractual partner is a merchant according to the German Commercial Code, the agreed place of jurisdiction is Hamburg.
